First, then NYSP Szoczei told Tantillo that he had a statement by Dean’s then girlfriend Leighanne Attridge-Kuchinick that they were both at Walmart in Macedon, NY using a stolen credit card from the Town of Richmond burglary of John and Jessica Alliet. He also told Tantillo that he had the two of them on Walmart security video using said credit card, and their car. This information was falsified by Tantillo, Szoczei and Dake.

Ontario County Sheriff’s Office Investigator Gregory J. Shaffer was present during the alleged statement of Ms. Attridge-Kuchinick and refused to perjury himself during the Grand Jury or trail testimony as Szoczei and Tantillo did. See what is called a police field note written by NYSP Szoczei, dated May 26, 2010, interview of Leighanne Attridge-Kuchinick with Inv. Shaffer (Ontario County Sheriffs’ Investigator) received on August 15, 2014 from the New York State Police Troop “E” Farmington, NY, to which NYSP Szoczei provided to his superior office, marked as (“A”).

Now see what was alleged to be the only field note written by NYSP Szoczei, that was provided to then OCDA Tantillo and in turn sent to Mr. Dean’s prior trial counsel Jeffrey R. Morrow, on February 28, 2011, hour after trial started, dated May 26, 2010, marked a(“B”).

Now see police field note written by Ontario County Sheriff’s Office Inv. Gregory J. Shaffer on May 26, 2010 of Interview of Leighanne Attridge-Kuchinick at the Monroe County Jail with NYSP Inv. Szoczei, and received by Mr. Dean on August 23, 2016, more than 5 years after trial and withheld by OCDA Tantillo for many years, marked as (“C”).

See the CPL 710.30 notice written by NYSP Szoczei of the alleged allegation made by Ms. Attridge-Kuchinick as noted in his field note that was added some time later, in an attempt to create evidence of a crime against Mr. Dean, as it was fabricated after the fact, marked as (“D”).

See black and white photo of T-shirt removed from Mr. Dean’s property at the Monroe County Jail on July 22, 2010, eleven days before the search warrant was applied for and obtained by Szoczei and Dake, marked as (“E”). Szoczei and Dake searched and photographed the property of Mr. Dean on July 22, 2010, allegedly took out the T-shirt in the photograph, and Szoczei told Dake to hold the photographs until August 6, 2010 so he could obtain a search warrant. See search warrant application by Szoczei, dated August 02, 2010, provided to Hon. William F. Kocher, Ontario County Court Judge, marked as (“G”), and allegedly executed on August 6, 2010, marked as (“H”), and return filed of seized property to which Szoczei and Dake claimed they removed on August 6, 2010, despite having done so on July 22, 2010, to Hon. William F. Kocher, Ontario County Court Judge, marked as (“I”), dated August 9, 2010 and photo of property allegedly obtained. The black and white photo was used at the Grand Jury Exhibit 8, claiming it was RED or ORANGE to Grand Jury members. Grand Jury and Trial testimony certified transcripts are available as evidence of such, marked as (“GJTS”).

Now see colored photograph provided to prior trail attorney Jeffrey R. Morrow, on/or about December 13, 2010 by Tantillo, Szoczei and Dake of the black and white photo provided previously of Mr. Dean’s alleged T-shirt that was seized by the alleged search warrant on August 6, 2010, to which is BLUE, NOT RED, ORANGE or any other color, and ignored by attorney Morrow, marked as (“J”).

The application for the search warrant says it’s RED and all the witnesses, police reports, Tantillo, Szoczei and Dake, and testified to the Grand Jury on August 26, 2010 and trial on February 28 through March 3, 2011, notes it is ORANGE or RED, and the mug shot photo showed it was ORANGE, NOT RED or BLUE.

Tantillo, Szoczei and Dake claimed it was BLUE to Morrow, and ORANGE or RED during closing arguments at trial. Tantillo finally identified Mr. Dean’s real T-shirt stating, it was RED with a SKULL and an ARROW going through its EYE, despite presenting a BLUE one and displaying one with a large black cross on the front with the words “MMA Elite” in a black and white photo to the Grand Jury and trail jury and as identified by the Walmart Asset Protection Manager during trial of Monti Harshfield to which he said it was RED with the words “MMA Elite” across the front of it.

See the RED T-shirt that Mr. Dean was really wearing shown in the photographs taken by the Monroe County Sheriff’s Office when he was unlawfully arrested for the false charge and arrest warrant issued by Tantillo with the East Bloomfield Town Court, taken on May 21, 2010, in the Town of Pittsford, NY, MC Sheriff’s Office Sub. Zone “A”, marked as (“K”).

See mug shot photo taken at the Monroe County Jail on May 22, 2010, some 12+ hours after the arrest of Mr. Dean, and he was in the Monroe County Sheriff’s custody the entire time, marked as (“L”).

Unfortunately for Tantillo, Szoczei and Dake, they did not know that Monroe County had taken the photos of Mr. Dean in the RED T-shirt on May 21, 2010, during an incident injury report of Mr. Dean when he was unlawfully arrested by Monroe County Sheriffs 12+ hours prior to the mug shot photo to which he was assaulted by officers.

This is a sample of the evidence found since his trial from 2011 to date and withheld by the former Ontario County District Attorney, Michael R. Tantillo, and some evidence is still being withheld by that office being run by OCDA James B. Ritts, to which also has refused to provide missing material exculpatory evidence as of November 26, 2018. Nor has the Ontario County Supreme Court Judge, Hon. Craig J. Doran been forth coming in enforcing his order issued to Tantillo and his former office on July 22, 2016 to provide Mr. Dean with a complete copy of his entire file and not done as of November 26, 2018 either. THE EVIDENCE USED IN THE FALSE CONVICTION OF WILLIAM DEAN BY TANTILLO, SZOCZEI AND DAKE ARE AS FOLLOWS HEREIN IN PART
